Well, finally, help is at hand. Financial Redress, the company behind Australia's largest ever class action against the banks for unfair penalty fees, is now looking at misleading and unfair mobile cap plans. We believe that the big operators have got plenty to answer for, such as:
- Misleading marketing - a "cap" isn't a cap at all, it's simply a minimum spend. "Included value" is a sham because it's calculated using grossly inflated call prices.
- Excessive charging - once you exceed your cap, the effective call rate can jump up to 10 times, causing many people financial hardship.
- Lack of disclosure - Some of the big providers still give you no warning that you are approaching your cap. Is it so hard to send an SMS ?
